1. Introduction

RESONAR™ respects your privacy and is committed to responsibly collecting, maintaining, and using your personal information. Privacy is important to us and we strive for thea highest level of protection in all processing of personal data, from the collection and use to the erasure of personal data. Our aim is to ensure that all personal data processed by us should be kept safe and secured at all times.

We process personal data in accordance with the European Union’s general data protection regulation (“GDPR“).

This Privacy Policy applies to anyone visiting resonar360.com , which are together referred to as “RESONAR™ Sites”, as well as to anyone using our services, products or otherwise interacting with us such as customers potential customers, suppliers, and distributors. However, this Privacy Policy does not apply to RESONAR™  employees or employee candidates.

This Privacy Policy describes how your personal information will be treated as you use the RESONAR™  Sites, our services, or products.

2. Information we collect from you

Is the data controller for personal data processed when someone uses our website or otherwise contacts us. Is further the data controller of personal data relating to customers and suppliers who use our products and services, or otherwise interact with us.

This also means that is the data controller for representatives of potential customers or suppliers who are either RESONAR™ Sites’ visitors, who submit personal data through any of the forms on the websites, or people who might be interested in our products and services whose information we got from other sources.

Will never use your personal data for any other purposes than those listed in this Privacy Policy, unless we collect your written consent or inform you prior to initiating any processing for new purposes or a purpose that is compatible with the purpose for which we collected the personal data, all in accordance with applicable laws and regulations.

3. Sharing of personal information with third parties

We may share personal information with members of RESONAR™  group for the purposes set out in this Privacy Policy.

Your information may also in certain cases be accessed by third party service providers who we cooperate with and who will process that information solely for our benefit and in accordance with our instructions and this Privacy Policy. However, we will not provide your personal information to or share it with any third party for their own marketing purposes except in connection with requests you make that clearly involve third parties.

Some of the third parties that we share personal data with are independent data controllers. This means that we are not the ones that dictate how the data that we provide shall be processed. When your data is shared with independent data controllers their data policies and personal data processing principles apply.

We may also disclose personal data to authorities to the extent we are under a statutory obligation to do so. Such authorities include tax authorities, police authorities, enforcement authorities and other authorities in relevant countries.

4. Retention of your personal data

We will not process personal data for a longer period than is necessary for fulfilling the purpose of such processing as set out in this Privacy Policy. We only retain your personal data to ensure compliance with our legal requirements. Your personal data will be anonymized or deleted once it is no longer relevant for the purposes for which it was collected.

This means that we as an example will only keep your data for as long as necessary for the performance of a contract and as required by applicable laws. If we keep your data for other purposes than those of the performance of a contract, such as bookkeeping requirements, we keep the data only if necessary and/or mandated by laws and regulations for the respective purpose.

  • Bookkeeping regulations: seven (7) years
  • Details on performance of an agreement: up to ten (10) years after end of the contractual relationship to be able to defend against possible claims

5. Links to third party sites

Links to web sites that are not operated by or for RESONAR™(“Third Party Sites”) are provided solely as a convenience to you. This Privacy Policy does not apply to Third Party Sites. We have not reviewed the Third Party Sites, do not control and are not responsible for any of their content or their privacy policies, if any. We do not endorse or make any representations about them, or any information, software, or other products or materials found there, or any results that may be obtained from using them. If you decide to access any of the Third Party Sites linked to from RESONAR™  Sites, you should understand that you do so at your own risk.

6. Transfers to third countries

If we transfer your personal data to a third country, i.e. a country outside of the European Union (“EU”), we will comply with all applicable laws in respect of such transfer, including making sure that your personal data is kept secure, and ensure that appropriate safeguards are in place to ensure there is adequate protection, such as entering into contracts in the form approved by the European Commission, so called Standard Contractual Clauses. RESONAR™  operates worldwide, such as in China, and may therefore share your personal information outside of EU to other members of the RESONAR™  group for the purposes set out in this Privacy Policy and we base such transfers and processing on the Standard Contractual Clauses. You can access a copy of the relevant EU model clauses used by us for transfers by entering the European Commission’s site.

7. Security

We process personal data in accordance with applicable laws and regulations and have implemented appropriate technical and organizational security measures to prevent that your personal information is used for non-legitimate purposes or disclosed to unauthorized third parties and otherwise protected from misuse, loss, alteration or destruction. Such technical and organizational measures are designed to ensure a level of security appropriate to the risks that are associated with our data processing activities.

8. Rights

As a data subject, you have certain rights stipulated in applicable law and we have listed these rights below:

  • You have the right to be informed about certain details on the processing of your personal data. We provide this information through this Privacy Policy.
  • You have the right to access the personal data we process about you. This right means that you have a right to (i) receive a confirmation about what personal data that we process about you, (ii) get access to your personal data, and (iii) receive certain supplementary information which corresponds to the information that is provided in this Privacy Policy. Please note that, upon your request to access your personal data, we might have to ask you to provide further information about yourself in order for us to be able to identify you and handle the request in an efficient and secure way.
  • You have the right to correct inaccurate or incomplete personal data we process about you.
  • You have the right to erasure the personal data we process about you (the so called ‘right to be forgotten’) if: (i) the personal data is no longer necessary for the purposes it was collected or processed for (and no new lawful purpose exists), (ii) your particular situation gives you the right to object to processing on grounds of legitimate interest and there is no justified reason for continuing the processing, (iii) the lawful basis for the processing is your consent, and you withdraw your consent, and no other lawful grounds exist, (iv) processing the personal data has been unlawful, or (v) there is a legal obligation for us to erase the data.
  • You have the right to restrict the processing of your personal data if: (i) the personal data we have about you is inaccurate, (ii) the processing is unlawful and you ask us to restrict the use of the personal data instead of erasing it, (iii) we no longer need the personal data for the purposes of the processing, unless we still need it for the establishment, exercise, or defence of legal claims, or (iv) you have objected to the processing claiming that the legal basis of legitimate interest is invalid and are waiting for the verification of this claim.
  • You have the right to data portability for personal data that you provided to us and if the legal basis for the processing of the personal data is the fulfillment of contract or consent.
  • You have the right to object to our processing of your personal data if: (i) you can show that your interests, rights and freedoms regarding the personal data outweigh our interest to process your personal data, or (ii) we process your personal data for direct marketing purposes, including but not limited to profiling.

If you choose to object to our further processing of your personal data as described in this Privacy Policy, please note that we may no longer be able to provide you with the services you have requested and may therefore terminate relevant agreements with you. In addition, we may continue to process your personal data for other legitimate purposes, such as to fulfill an agreement with you, to protect our interests in connection with legal proceedings and to fulfill our legal obligations. If you have received marketing from us, you may at any time object to the marketing by contacting us at privacy@mipsprotection.com or opt out by following the instructions in the marketing material.

Please note that there are exceptions to the rights above so for example access may be denied where we are legally prevented from making a disclosure.

You also have the right to lodge a complaint to a Data Protection Authority if you believe that your personal information has been collected or used in breach of relevant privacy regulation. If you are located in the EU, this will be the Data Protection Authority in the country in which you are located. You may also seek a remedy through local courts if you believe your rights have been breached.

9. Children’s privacy

RESONAR™  Sites and services are not directed to children under the age of 16. We do not knowingly collect personal information from children under the age of 16. If we receive personal information that we discover was provided by a child under the age of 16, we will promptly destroy such information

10. Automated desicion

Currently RESONAR™ does not carry out any processing that is defined as solely automated decision making, including profiling, that has legal effects or otherwise significantly affect you.

11. Use of cookies

Cookies are text files placed on your computer to collect standard internet log information and visitor use of the website and to compile statistical reports on website activities. You may set your browser not to accept cookies. However, in a few cases some of the RESONAR™   Sites features may not function as a result.

12. Changes to this privacy policy

We are constantly working on improving and developing our services and the RESONAR™   Sites so we may change this Privacy Policy from time to time. We will not diminish your rights under this Privacy Policy or under applicable data protection laws. If any changes should be significant we will provide a more prominent notice when we are required to do so by applicable law. Please review this Privacy Policy from time to time to stay updated on any changes.
